These terms govern your facility's use of Draco Learning LMS. By creating an account or paying an invoice, you agree to them.
Service
Draco Learning LMS is a compliance, in-service, and continuing-education tracking platform for skilled-nursing and assisted-living facilities. We provide the platform; you provide your training content (or build it in our Course Builder).
Subscription
The subscription is month-to-month, priced at $1.98 per active user, per month, with a 50-user minimum ($99/month); each active user beyond 50 adds $1.98. Pricing is published at our marketing site and is the same price you see on every invoice. We bill via Stripe; payment is due net-30 from invoice issue.
You may cancel any month before the 1st by deactivating your subscription in the Stripe Customer Portal or by emailing damien@dracolearning.com. There is no notice period and no early-termination fee.
Acceptable use
You agree to use the platform lawfully and not to:
- Upload content that infringes intellectual-property rights.
- Attempt to bypass authentication, rate-limiting, or other security measures.
- Use the platform to send unsolicited messages outside its built-in notification system.
- Resell the service or grant third parties access to your facility's account.
Your content
You retain ownership of all content you upload (courses, lesson media, knowledge-checks, completion records). We do not claim license to it beyond what's necessary to operate the service.
Our content
The platform itself — code, designs, brand assets, copy — is the property of Draco Learning and is licensed to you only for the duration of your active subscription.
Service level
We make commercially reasonable efforts to maintain platform availability. We do not currently offer a contractual uptime SLA; the platform runs on enterprise hosting with daily backups, and operational status is published in real time at /status.php. For multi-facility enterprise customers requiring a written SLA, please contact us.
Data ownership and portability
Your facility's data is yours. You can export it at any time. If you leave us, we will provide a full structured export of your dataset on request. We retain backup copies for 90 days post-cancellation in case you wish to resume; after 90 days backups are deleted.
Liability
Draco Learning's aggregate liability for any claim arising from the service is limited to the fees you paid in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
The platform is provided "as is" and we make no warranty that it will meet every regulatory requirement applicable to your facility — that determination is yours and your compliance team's.
Modifications
We may update these terms with at least 30 days' notice to active facility administrators by email. Continued use after the effective date constitutes acceptance.
Governing law
These terms are governed by the laws of the State of California, USA.
